Hiring and Lending Agreement - Electric breast pumps

This agreement applies to hires of electric breast pumps from the Australian Breastfeeding Association.

Agreement

By ticking the checkbox during checkout, you confirm that you have read and agreed to the following terms and conditions for hiring an electric breast pump from the Australian Breastfeeding Association (ABA).

1. The Hirer shall contact, at least weekly, the Australian Breastfeeding Association Breast Pump Hiring Officer named in the Local Group Breast Pump Hire Booking form during the period of hire.

2. The Hirer will pay to the Association the hiring fee per week or part thereof (as detailed online), together with any applicable GST, weekly in advance. A deposit is also required and will be repaid within a week of the return of the equipment, provided all equipment is returned in good working order, and no money is owed.

3. The Hirer requests that the Association processes recurring fortnightly payments of the hiring fee, together with any applicable GST and payment processing fees, for the duration of the hire period (which may be extended at the Hirer’s request).

4. The Hirer shall keep all equipment clean as directed and agrees to return it in a good clean condition at the end of the hire period. If unsure how to clean the equipment, the Hirer will contact their ABA counsellor before use.

5. The Hirer shall be responsible for the cost of replacement of any broken or damaged parts or loss of the equipment, at current retail prices, to be paid on demand.

6. The Hirer shall be responsible for payment of all transportation expenses related to the equipment.

7. The Hirer shall not repair, service, or interfere with the motor or fittings in any way. Any required service must be handled by returning the pump to the Association.

8. The Association hires out equipment in clean working condition but makes no warranty as to its effectiveness. The Association accepts no liability in relation to the use or cleanliness of the equipment.

9. Except as required by law, all warranties are excluded. Where warranties are implied by law, ABA's liability is limited to replacement or reimbursement, as permitted by law.

10. The Hirer shall only use the equipment at the address provided during checkout. ABA reserves the right to retrieve equipment not returned within 7 days of the end of hire.

11. The Association may terminate this agreement with 7 days’ notice and collect the equipment thereafter.

12. Without limiting any other term, the Hirer authorises the Association to charge all monies payable to the Hirer’s credit card.

13. The Hirer acknowledges that they have reviewed the leaflet ‘Suggestions on Using an Electric Breast Pump’ provided online.

14. The online booking form completed during checkout shall form part of this agreement.
