Terms and Conditions 

Our Terms of Service for the “Meet-up” functionality within the ABA mum2mum app contain important information about your legal rights as a service user. They form an agreement between you as an ABA member and user of Meet-ups and the Australian Breastfeeding Association (‘the Association’). These terms of service should be read in conjunction with the ABA mum2mum app Terms of Service

This Agreement 

The ‘’Meet-up” functionality within the ABA mum2mum app enables ABA members, “you”, to find and connect with other ABA members within 100kms of your location, for the purpose of arranging local, social catch ups for yourselves and your children. 

The ‘Meet-up’ functionality in the mum2mum app is only available to financial ABA personal members, it is not available as part of the free mum2mum app offering or Basic Bundle.  

This agreement is between you and the Association, not between you and any other ABA member using Meet-ups. 

We use the terms “we,” “us,” and “our” to include the Association. We use the word “App” to mean the ABA mum2mum app and associated services.  

Your use of Meet-ups is subject to the Agreement in these Terms of Service. Your use of Meet-ups constitutes your agreement with these Terms of Service. If you do not or are not in agreement with these Terms of Service, do not use Meet-ups in the App.  

If we change this agreement, we will inform you by publishing the updated version of this agreement on our website with the revision date. Your continued use of Meet-ups after these changes commence, constitutes your agreement. If you do not accept the changes to the Agreement, you can ‘hide’ your profile via the Settings tab. 

Your Profile and ABA membership 

Only ABA members aged 18 years or older are eligible to use Meet-ups.  

By using Meet-up you agree to providing accurate, current and complete information in your profile for publishing in Meet-ups. We may suspend or terminate your access to the App if, we determine that you are in breach of this Agreement, or that it is in the best interests of the ABA community or to protect the Association or App. If we take this action, we will notify you via email of the reasons for your account suspension or termination. We may from time to time remove the accounts of ABA members who have been inactive for more than 5 years. You can email app@breastfeeding.asn.au to appeal our decision to suspend or terminate your access to the App.  

Account security and personal information 

In order to access the Meet-up functionality in the App you must have a current paid ABA membership, and you need to have registered for an app/ website account. You are responsible for maintaining the confidentiality of your account credentials and you are fully responsible for any activities undertaken with your account.  You must not share or transfer your account details to any other individual. You must immediately notify us via app@breastfeeding.asn.au about any suspected or actual, unauthorized or fraudulent use of your Account or any other breach of security. 

Maintaining your ABA membership 

You are responsible for ensuring that your ABA membership remains current enabling you to access Meet-ups. ABA memberships may be provided as an annual, bi-annual or monthly payment option. Membership fees may change in the future.  

Deleting your Account 

You can hide your profile in the mum2mum app via the settings tab in Meet-ups. You can delete your mum2mum account and terminate your use of the services at any time, without cancelling your ABA membership. 

Diversity and inclusion 

ABA is a welcoming and judgement free space for all parents across Australia, to gain support and trusted information for their breastfeeding and parenting journey. ABA includes and welcomes all parents irrespective of a person’s country of birth, culture, language, race, religion, disability, sexual orientation, gender identity or marital status. 

ABA members may identify as mums, dads, parents or grandparents or others. All ABA members are eligible to use Meet-ups.  

ABA welcomes and supports members from Aboriginal and Torres Strait Islander communities and the LGBTIQA+ community to engage with and access our services.  

Privacy Policy 

We take your privacy very seriously.  Any personal information you submit to use when setting up an account will be subject to our privacy policy which is also found on our website.   You understand that through your use of Meet-ups you consent to the collection and use (to the extent stated the Privacy Policy of this information) of this information.  You further understand that, acknowledge and agree that any personal information you provide in your profile is in the public domain and is provide at your sole liability.  ABA accepts no responsibility whatsoever for the use of any personal information you share on your profile by you or any other individual. Our Privacy Policy explains how we collect and use the information you provide. 

Posting information, user content and communications  

You are responsible for the Content you post in your profile in the App and for rendering your profile ‘’Active”. You give the Association permission to use this Content to operate Meet-ups. By being responsible for your Content, you agree that: 

• You have the right to provide the Content to the App 

• Your Content does not breach the privacy or rights of others 

• Your Content does not breach our Code of Ethics or Constitution 

Your use of Meet-ups 

When you use Meet-ups you agree to comply with all applicable laws and regulations and not to breach the rights of others. If you do not comply with this agreement we may suspend or terminate your access to the App.  

The Content of others 

The Association does not control the Content of other ABA members. When we become aware of user Content that may breach this agreement, we reserve the right to investigate it and take action as we see fit. We are not obliged to monitor user generated Content or their interactions with you.  

Prohibited uses of the app 

You agree that you will not use the App to solicit or collect the personal data of others except as necessary for the purposes of arranging a meet-up with another ABA member. 

Safety and security within Meet-ups 

You agree that you will not extract data from the app for a commercial purpose by any means. You also agree to use and retain personal data collected from the app in accordance with applicable laws and regulations and solely for the purposes of arranging a meet-up with another ABA member. You agree to safeguard such data from unauthorised access or processing. You must delete such personal data once it is no longer required for the purposes of arranging a meet-up with another ABA member. 

Changes to the operations of the app 

We reserve the right to change or discontinue functionality within the App, with or without notice and without liability to you or any third party. 

Release from liability and indemnification 

As permitted by law, you agree to release the Association from responsibility for anything that happens related to the connections made between you and other ABA members via the app. By accepting a connection or meeting-up with another ABA member, you acknowledge and agree to accept the risks and any inherent dangers of these activities. 

You agree to indemnify the Association against any claims made by a third party due to your breach of this agreement, use of the app, violation of any law or regulation or your conduct in accepting a connection or meeting-up with another ABA member.  

Disclaimer of warranties 

THE MEET-UPS FUNCTIONATLITY IS PROVIDED "AS IS." WE MAKE NO REPRESENTATION OR WARRANTY OF ANY KIND WHATSOEVER TO YOU OR ANY OTHER PERSON RELATING IN ANY WAY TO THE SERVICES, INCLUDING ANY PART THEREOF, OR ANY WEB SITE OR OTHER CONTENT OR SERVICE THAT MAY BE ACCESSIBLE DIRECTLY OR INDIRECTLY THROUGH THE SERVICES. WE DISCLAIM TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY AND ALL SUCH REPRESENTATIONS AND WARRANTIES. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, WE DISCLAIM, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY AND ALL (i) WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, (ii) WARRANTIES AGAINST INFRINGEMENT OF ANY THIRD-PARTY INTELLECTUAL PROPERTY OR PROPRIETARY RIGHTS, (iii) WARRANTIES RELATING TO DELAYS, INTERRUPTIONS, ERRORS, OR OMISSIONS IN THE SERVICE, OR ANY PART THEREOF, (iv) WARRANTIES RELATING TO THE TRANSMISSION OR DELIVERY OF THE SERVICE, (v) WARRANTIES RELATING TO THE ACCURACY OR CORRECTNESS OF DATA, AND (vi) WARRANTIES RELATING TO PRIVACY OR SECURITY OF THE SERVICES OR OTHERWISE RELATING TO PERFORMANCE, NONPERFORMANCE, OR OTHER ACTS OR OMISSIONS BY US OR ANY THIRD PARTY.
